Federal Appeals Court Upholds Gun Bans as Bail Condition

A U.S. appeals court ruled on Monday that barring defendants out on bail from possessing firearms while they are awaiting trial is constitutional, reports Reuters. This ruling helps interpret a 2022 Supreme Court case -New York State Rifle & Pistol Association v. Bruen - that expanded gun rights. The Supreme Court recognized for the first time that the Second Amendment protects an individual's right to carry a handgun in public for self-defense.


However, the U.S. Court of Appeals for the Ninth Circuit rejected the arguments that pre-trial firearms restrictions interfered with the defendants' Second Amendment rights. U.S. Circuit Judge Gabriel Sanchez said that disarming defendants before their trial is a temporary restriction on liberty that helps protect the public.
